mother's will
« on: June 24, 2015, 06:31:06 AM »
My Father had 2 marriages. He had 2 children from his previous marriage and married my mother, from whom he had 2 kids, my brother and  myself (her daughter).

My father owned flat in Mumbai and shares in various companies. My father wrote a will were he had given everything to my mother and nominated her for the transfer of shares of the property in Mumbai. Upon his death she transferred the flat and shares into her name but did not share the my father's will. We did not ask as well.

she now passed away without writing a will but has signed the nomination papers of the flat to my brother whom she lived with. During her stay with him he has converted all bank accounts into their joint names and taken over all the gold and jewelry which she had. She also has a land in Bangalore which she wished to give to the two of us in equal share and a flat in Pune which was jointly owned by my mother and brother

my questions are

1. do my other siblings have a legal right on the Bangalore property in the absence of her will. since the property was purchased by her and not by my father?

2. Since my brother has the nomination papers of the flat in Mumbai. does he own the flat?

3. what happens to the joint bank accounts held my mother and the jewels she possessed?

4. Upon her death does my brother automatically fully own the jointly owned Pune property?

If your mother has not transferred the property to your brothers name, then you can always claim equal share in it. No other siblings do not have any share in it. I do not know what you mean by nomination papers, but if your mother has gifted ot settled the property in your brothers name then he owns it. You can claim share in your mothers jewellery and money if you can show how much money your mother had at the point of time when she passed away.
