How to get Divorce case transfered Filed in another state
« on: July 05, 2015, 12:05:18 AM »
My Brother-in-law filed Divorce case against my sister in state where he is working. We both are permanent residence of same city and state.

Questions :
1.   How to transfer the case to our own state.
2.   Is there any way to get transfer without appearing once over there.
3.   As case is filed as ex-party what will happen if we dont appear on that day
4.   When and what cases she should file here for her rights, she is not willing to take divorce.

Sir,

If the case has to be transferred from same state to another court then HC of the concerned state can do it, if from one state to another then only SC can do it.

For transfer it is advisable to appear.

If you don't appear the case will be proceeded ex-parte for sure.

She can file cases depending on the facts and circumstances of the case .

Warm Regards

Thank you Kapil.
1) How many days it will take for transfer after approaching SC.
2) Should we lodge complaint in police station, as we are suspecting that they can injury or act of stop from appearing.
