cheque bounce an offence when it is a legally enforceable liability or debt and that it has been returned by the bank for the reason for insufficient of funds in the account.

Also  it will become an offence under Section 138 of the Negotiable Instruments Act if proper notice in writing to the drawer of the cheque demanding payment is issued and failure on the part of the drawer to make payment within 30 days of receipt of the notice.
