Tenant refused to vaccant

Hello Sir
we have rented two rooms in our house to a family. There is this lady with her three childerens who stays at home her husband is working on some ship in Mumbai. She is been occupying our room since last four months. we don't have signed any agreement.
she always start to fight and start abusing us every time. Now we asked her to vacate our rooms then she said that she is never going to vacate our property and started fighting and was challenging us to do whatever we can and now she had made complaint in police against us for fighting with her. She is also threatening us that she will blame us for molestation. Sir please help us tell us what we can do ???

since you don't have a rent agreement why are you considering her as tenant.

have you taken rent from her as yet?

You have to proceed under bombay rent control act to get her evicted. Even if there is no agreement between you and your tenant, your conduct is enough to establish the relationship. You can get the complaint quashed under Sec.482 of CrPC as it is a frivolous complaint and the real dispute is civil in nature.
