Drunkard husband..PLEASE HELP ME
« on: July 25, 2015, 01:41:45 PM »
Hello mam/sirs,
I am a well educated but unemployed 30 years old woman married to a 35year old well earning(respectable job & he belongs to a very respectable & reputable family) but drunkard man for 4 years. We have a 2 year old daughter & I am expecting another baby!
Well, I am a civil services aspirant, gave ias interview twice, net qualified and now also preparing for ias. But this man has made my life hell. He drinks daily to the point he loose his senses, behave oddly, torments me emotionally, tortures my soul & had also hurted me physically several times in the past. It has become almost impossible to live with him. I am very ambitious and want to achieve something but he doesnt support. We talk rarely & have almost nil mutual love.He is irresponsible. I have lost all the self respect & respect for him. I have become a broken, fragile person which I never was and very miserable because I don't know what to do. I don't have a job, can't settle for lesser one and with two children I don't know where to go. I don't want to bother my parents too as they have already did so much for me. His family is also not helping and his mother behaves as if he is my problem. The only way out is divorce I think because I can't raise my children with him & he can never change & accept sobriety.. I m sure. Please suggest me how to proceed with the divorce procedure. How much alimony or maintenance should I ask for? And yes when his mother found out that i might take an exit from this marriage then she started shifting his property in her name. His parents own a handsome property. My parents also had spent more than 30 lakhs on my marriage and gave a lot of gold & dowry..what about it? And as he belongs to such a high stature family, will it affect the divorce procedure?
P.S. I want to live my life & want to raise my children with dignity & pride.

Pl help

Thanks in anticipation
Regards

Just filing for divorce won't get you divorced.
regarding child maintenance that is assured when you file for it the court will grant you this.

regarding your maintenance, are you working? If yes than that will depend on how much or if at all maintenance is applicable in your case.

Thanks for your response mam.
I don't work at present.

Well, what about the money spent on my marriage and my fixed deposit which my parents in law took after marriage?
And whether I should ask for a lump sum amount or monthly maintenance?

Thanks in anticipation

Fix deposit are yours why would your in laws take that from you.
You should try to convince your husband for divorce by mutual consent and settle down with a one Tim lump sum amount.

They asked me to sign a check on name of my father in law and that's how I broke my FD before its maturity and showed that I gifted that much amount to my father in law. They already spent that money. Could I ask for it now?
And mutual divorce is a possibility but my husband is always busy in his office in day time and drinking in night. And my mother in law isn't going to give me anything. She already started transferring my husband's property in her name.

If your husband is trying to transfer property to someone else name which i doubt they would do, as that will require stamp duty payment and from your mail it is pretty clear your husband and in laws are not going to spend money.

anyways get an order from court to stay all transfer till your maintenance case is pending
