Credit Card Collection Practices
« on: July 27, 2015, 10:42:52 PM »
Hello All,
I need some advice with regards to a text message sent to me from one of the credit card company, The message stated that "There is a FIR is getting lodged against me in the police station for non payment, To avoid police coming at your residence along with legal department kindly make a payment"

My question to you all is
1) Doe credit card companies file FIR for non payment? if Yes, then after how many months delinquent can the file a FIR
2) Do credit card companies have the authority/policy to send text messages like above?
3) What options do I have to take actions against this credit card company for sending a unethical text message like this which made me run around to gather funds and pay the minimum amount due.

The have their pull in police station, they make poluce officers scare you over the phone so that you quickly pay.

ask the bank on a settlement amount.

and solve it.

The credit Card Company do not have any right to lodge FIR against you as there is no criminal offence committed by you save and except file a Money Suit before appropiate forum, if there is genuine outstanding on your part. All those msg/ sms are some sort of extortion or better say false criminal implication. But at a same time you should not keep mum under this vital circumstances. First if you have any outstanding to them, then you should reply via email and/ or via speed post with A/D and should clear your outstanding with reasonable equal monthly instalments.

*** If you have already paid your minimum monthly outstanding to your credit card company, then you should  send a legal notice to the company and may lodge a GDE before local police station against the company with the SMS number. Better to consult a lawyer under this situation.
