Land Transfer from my Uncle's (expired) name
« on: August 21, 2015, 11:42:40 PM »
Dear Experts,

My father were four brothers and my father was youngest. One of my father's elder brother has no children and his wife also expired long back. When uncle's health started deteriorating we got him shifted to our place in the city and took care of his health and he was dependent on us. In 2010 my father expired and in 2011 my uncle expired. There is some agricultural land to uncle's name in our ancestral village. Now we want to get this land transferred to our name (me and my elder brother). No one from our other uncles' families has any objection to this as everyone acknowledges that we took care of his health and needs so we should be inherent to his property. So what is the process and how to begin with. we are from uttar pradesh and hindu.

Regards

As per Hindu Succession Act, if the property devolves upon you and your brother then you along with your brothers are the owner by inheriting. To get your mutated before appropriate authority you and your broethr just need to take oath by Affidavit before 1st Class Judicial Magistrate. This will be enough for your requirement.
