Regarding signature on vakalatnama
« on: August 22, 2015, 12:49:42 AM »
Hi,

Last year my cousin uncle and my family (uncle and my family) decided to partition ancestral land. Now my cousin uncle filed a case against my family (me and my mother as my father is not alive) and uncle (my uncle and my father are real brother). As the ancestral property is at remote location so we have given authority to lawyer to represent our case. And my uncle and mother has signed vakalatnama and gave to lawyer. But now lawyer is asking for mine signature on vakalatnama as well. So I wanted to check if my uncle can use that vakalatnama for any wrong thing. Please note my uncle and my family relationship is not well and we had dispute in past.

Please suggest..

As you said you have been made party to the partition suit then you have to represent yourself through a lawyer by giving a vakalatnama. Now your uncle and your mother has appointed a lawyer jointly to represent them jointly so there is no wrong for you to give a vakalatnama to that advocate.

Now, if you have any doubt then you can change your lawyer along with your mother at any point of time before it is too late. You must follow up your case on every date otherwise you could face a bitter situation.
