Blockage of Common Passage to Common Roof

Pls advise remedy - on private builder floor, second floor owner with roof right built third floor and blocked stairs from front side to the roof top for free access for going to water tanks, placing dish antenaes etc - has also locked the staircases from start of first floor entry - which is actually common passage.  At time of construction, ten years back, he said you can go to the roof top through his third floor and go up to the roof from the backside.

Can we now initiate legal or police proceedings now to make changes as he did not agree to them at the time of construction as we now want to sell our floor but new buyers are objecting to this arrangement.  Thank you.

ROOF, Stair Case and other list of areas have been specifically mentioned in the law under the heading of common areas and facilities. It will not be a proper to initiate criminal proceedings against your developer rather filing a suit for declaration and permanent injunction against the developer will solve out the actually problem which you have been facing.
