Informing employer about marriage - Urgent help required
« on: August 27, 2015, 05:44:27 AM »
Respected Sir,

I work in the Income Tax department and due to unavoidable family situations i had to marry my girl friend, we registered the marriage,

Now both the families are arraning a formal wedding next week, but my superiors are threatening me that i need to face action since i did not inform them about the registered marriage, though in the All India service rules it is not mentioned that i need to inform them,

Please let me know the legal opinion about this

There is no scope of your superior officers to take legal actions for your marriage. Marriage is an absolutely fundamental rights of citizen of India. Those threats are illegal. You can enjoy your life as you are enjoying till date. If any further situation occurs please inform me, I will give you advice on legal steps.

If you are satisfied/ happy with my advice, please click on 'APPLAUD' just on left hand side of this post.

learned adv amarnathji had rightly advised.also record the threatenings made by your superiors as i feel it would be useful in future to prove their wrong intentions if they try to put any other false allegations on you

Sir, sincere thanks to both of you, They have informed me that I should not leave for my wedding which is to be held by next week, they have stated that it was against the rules to register marriage without informing the department, However I could not find such rules in the All India service rules,

Please let me know what to inform them, I am hesitant to proceed with legal action against them since it might affect my career

Please advice me on what to do sir

If you want to avoid legal proceedings then you have very limited options to fight against baseless situation created by your heads. You can send a letter narrating about the entire incident to the officials head or superior  to your head. Further for creating evidences, you must send a leave notice for the wedding purpose with an invitation card particularly to that person. You must include a statement that if your leave is not granted or granted, all must be given in written by your head. The letter must be received by you head with 'Received Seal'. If he refuse to acknowledge the same then you have no other alternatives except to send via speed post immediately.
