Wife Is Missing Since 1.5 Years

Dear Sir,

I need to Know my wife is missing since last 1.5 years, The FIR has been Logged in the respective police station for the same.But We are unable to trace her and even she is not at her Parents Home since the time of missing.
And My Question Is Can i Get Re-Married On the Basis of An Affidavit that has been provided to me by my parents In-laws that they no objection on my second marriage.

Definitely not. Who told you about this law or rules of getting re-marriage with the support of an affidavit executed by your in-laws. Even you wife signed such type of paper giving you liberty to re-marriage then also you have done crime once you get re-married.

Your best and ultimate option is that you have to wait for 2 years from the date of her missing diary/ FIR before local police station. After expiry of two years, you can file a divorce case against your wife on the ground of cruelty and desertion. It will take hardly 1 one year for getting divorce. After getting divorce decree, then you can re-marry.

It is suggestible if you make a paper publication for your wife under the heading of MISSING since ..........

thank you sir for your suggestion i have already filled a FIR since the date of her missing so i cant file the divorce right now

I have told you that until 2 years is expired from the date of missing you cannot file a divorce petition under ground of desertion as well as cruelty. Paper publication is suggestible for your benefit.
