Hi All Respected Lawyers,

Need your help.

I am originated from Bihar. My Father hold a property in Bihar where my Elder brother and his wife along with 2 children are living for past 8 years ever since their marriage and they kicked my Parents out from their home. My Parents wants to get it back however my brother's in-law's are enemy to us. I am keeping my Parents with me in Delhi and we live in rented house ever since they are out from their home which was build by my father on Grandfather's land. My Family Inlcude:
MY Father: 63 Yrs (Retired Teacher)
My Mother: 61 Yrs (House Wife)

My Eld Broter: 36 Yrs (Private Job)
   His Wife:   27 Yrs (House Wife)
My Eld Sister: 30 Yrs (House wife)
   Her Hus:    34 Yrs (Farmer)
Myself:        26 Yrs (Private Job)
   My Wife:    26 Yrs (Private Job)

I need your suggestion about how should I proceed further and get our shares in property. Property value worth 30Lac.

You have not stated clearly that who is the owner of the property where your brother is staying in Bihar. Considering it is your father's property then there are several ways to kick out of your brother from that property. But due to professional reasons and technical reasons, I cannot disclose my tactics in this open forum.

Hi Mr. Sanyal,

The property is on my Mother's name given by my Grand Father. My Brother is not well educated and his wife is so dumb or super smart you can say. They are asking my Parents to Give them Half of Pension amount which he has received and half of the property then only he agrees to the Partion.

My Father's real age is 67 and mother's 61. Mother's right kidney is non-functional so at this age they can not just give out the money my bother wants. Neither I use that money for me or my wife.

You can say my Parents living like refeusee life (In rented house) in the same city (Gaya, Bihar) away from me(Delhi) sometime they come to Delhi for treatment in AIIMS. Money is the only thing by which they can survive. Need your suggestion.

There are several procedures to evict your brother and his family from that house as well as to put in so much trouble, he will compromise with your parents. It is very bless full for you to be on side of your parents. Therefore, in simple word, your mother can file evict suit after serving notice to them.

There are some alternatives to handle this situation with iron hands which I cannot disclose here due to my professional reasons. For further clarification and advice in details, you can contact me.
