Please advice what to do

I am an Hindu Bengali married for 3 month...my inlaws and my husband created trouble after marriage about jewellery with my family....insulted my family....insulted my elder sister....called her prostitute and said all nonsense things....... on the nite of marriage my husband forced himself without puting sindur and without my consent .....after marriage he kept all my jewellery in his locker and locker doesn't have my name we stay in Dubai there is no fridge or gas stove in the house only an induction...i have to cook all day....and he jus sleeps during weekends and now when i became pregnant...after 2 month of my marriage......my mother in-law and my husband wanted me to abort my pregnancy ....according to them the baby will be unhealthy....with all these tension i had an miscarriage it was 4-5 weeks pregnancy... what should i do.....what guarantee is there that this won't happen again

Madam,

I am too Hindu Bengali from Kolkata. I have understood your problem which is very unfortunate for you. But as  you are in Dubai, so no Indian Laws is applicable there and it will not be correct to advice you with Indian Laws. But once you come in India, then all the laws of India will be by your side. Whatever your husband and in-law are doing are definitely falls under cruelty and several criminal laws of Indian Penal Code.

Thank you for your advice sir....i got married in mumbai and they are from baroda...i and my husband live in dubai but now i am in  mumbai as my father is unwell....i'd like to know my rites....

It is not about what rights you have. There are many options for you.
If you start filing all of them than you would land up in total mess.

First let us know what outcome are you looking for. Do you want divorce, or do you want compensation etc

Once the target is set we can tell you exactly what to file and how to quickly achieve that goal.

Remember blindly filing listening to inexperience people will land you nowhere.

There are several matrimonial options are available. But primarily you have to decide that what you want now. Do you want to continue your matrimonial life with your husband and giving them one more opportunity or there cruelty is just intolerable for you.

If you want to break the marriage tie then there are several options you have legally. If your marriage is not been one year old, you cannot file a divorce petition. Moreover, I will not suggest you to do same. But you can file a maintenance petition against your husband and claim his half income. Further lodge a FIR under 498A and relevant provisions which fits in your situation. These steps will be enough for you to give a proper reply to your husband.

thank you for your replies....i also want to know if i don't want to go can my husband force me to go with him....if i don't apply for divorce.... only 3 month marriage

No, your husband cannot force you to go with him neither any judicial order can force you to cohabit with him. It is very unfortunate that these all cruelty happened to you in a matrimonial life which is merely 3 months old. Therefore you cannot file any divorce petition until and unless your marriage is 1 years old. It is a statutory law.  But you can file criminal case against him as well as a maintenance case can claim half of his salary.
