Land grabbing attempt with forged documents

Dear Sir,
My Grandfather purchased a land in 1970 by paying the demanded amount to the seller. The seller is now no more. At that time the said land (1 acre and 20 cents) was not registered but my grandfather obtained a 'Patta' in his name for the said land. EC from 1970 till 2013 states 'No transaction or entries' and the land is in my grand father's name only.
My Grand father passed away in 2001 & In July 2012 my grand mother passed away. Using this opportunity, the ex seller's husband's brother registered this land to another party by using a different patta number. The new party who purchased the land claims that this land belongs to him.

We are in possession of this land since 1970 and patta is on my grand father's name. We have lodged a complaint in district SP office. Appreciate your advise on way forward.

By patta no one can be the owner of the land. It was a great blunder on the part of your grandfather for not registering the Deed of Sale into his name. Mere possession for several years does not creates any title. If you have any documentary evidence to show that your grandfather had purchased the property with monetary value , then you must file a civil suit immediately for declaration and injunction.

This is a civil dispute police will be reluctant to interfere.

Many thanks for your immediate reply sir.

The seller filed a petition (in 2006) in a district court saying that my grandfather paid only Rs-6100/- instead of 6500/- (value of the land). Whereas my Grand father paid him the full amt. This petition was dismissed by the same court (in 2007) as he withdrawn it for some reason!. Therefore it is an objective evidence for us that the land was sold by him for a monetary value which he himself agreed vide his petition to the court.

In Tamil Nadu we have 'Anti-land grabbing cell' and they are dealing with this case now. You still advise us to file a suit?. we are afraid that by doing so, it will become a civil case!.

I will be happy to send you any relevant doc copies if you would like to see.
