Disciplinary proceedings for misappropriation of funds

Hi

My brother is in banking sector, he is facing disciplinary proceedings against him on the account of misappropriation of funds, and is currently suspended for the past 4 months.He has admitted his mistake and given back the amount to the bank.
Please advice as how to safegourd my brother job, we are for the past 4 months are living in stress...

kinldy advice on the legal front and also what steps should he take so that his job is intact

Since he has admitted, he is at the mercy of the management. He can be easily removed in the grounds of loss of confidence. Courts generally do not interfere.

If he is dismissed from services, can he do job in the same sector,and show his previous bank work experience, and kinldy illustrate the difference between removal form service and dismissal from service

Layoff is simply removing from job, but dismissal will be removal as a punishment. If someone is simply laid off then there is no stigma attached and so he will easily find a new job. That is not the case with dismissal as it will be a black mark on his career.

Hi
This is in continuation,
my brother has been suspended from his company on account of misappropriation of funds, he works in a bank. after four months of suspension, he has now been asked to give STATEMENT OF DEFENCE, he has already accepted his mistake and paid back the amount to the bank, now i only want his job remain intact, kindly help how to draft statement of defence so that he may be able to save his job
