My Great grandfather distributed his wealth to his children where my grand mother got her share of cash. My grandmother then distributed that money among all her three sons. My father further added some amount in it by taking loan from bank and bought a house. My grand mother gifted this house to my elder sister alone as I was not born then. My grandmother and father both have passed away. Can I claim my share in this property now?

You have not clearly explained how the property is distributed and please make you statement simple. You are making it too much complex.

My Fatherís grandfather gave my grandmother(his daughter)  some cash as her share from his property.

My Grandmother divided the amount in three parts. One part was given to my father.

My Father took loan from bank and added money in the amount given by his mother i.e. my grandmother.

My grandmother bought the house on my sisterís name when I was not even born. My father was set as a guardian of the property till my sister turned 18. Now my sister is 35, unmarried, has claimed in the society for transferring the house entirely on her name.

My sister is refusing to give me a share from this property. Can I claim my share in this property?

If the Deed of Sale is in the name of your sister then you cannot claim it. It is her absolute property which she acquired when she was minor (Property was purchased in the name of her). Surely the deed of conveyance was signed by her natural guardian (Father/ Mother). There is no need of her to claim or transfer the entire property in her name as she is the owner.

I need to check Deed of Sale and deed of conveyance  papers but the problem is all the documents are with her and she is refusing to share them with me. Is there any legal way by which I can claim to check them?

Make a search before all Registrar office within the jurisdiction of the property
