Dividing a house which were bought as one unit
« on: September 27, 2015, 01:30:56 AM »
Hello,

I hope this is the right forum for this question.

Description of the scenario:

My family currently lives in a house which was bought as 1BHK + 1 RK in Thane, Maharashtra. This 1BHK+1RK is specific only to our house in entire building & was constructed like this by the builder upon our request after all the approvals. Thus house was bought as "one unit" on first floor of the building with only one sale deed. Now me & my parents want to separate this 1BHK & 1RK into two different units & rent the 1RK as it is no longer in use.

My question:

Is it possible to separate this 1BHK & 1RK unit into two different units & if yes what will the procedure for this?

Please forgive me in advance if the scenario is not phrased correctly & for lack of using proper terms.

Thanks & Regards.

It is not possible as well as it is not at all required. Single Deed is enough.

Thanks for the response Adv. Amarnath.

We want to divide our apartment into two separate apartments. Is this not possible because we have a single sale deed?

If it is attached then you can make it permanent partition by making construction. No need of separate deed or paper works. I don't think so...
