Notice from labour inspector

Hi,

I am an individual general insurance agent doing work from home. I expelled some of my employees due to non performance.I recently received a notice from labour inspector under two sections. Shops and establishement act and minimum wages act. My question is :

1. Whether shops and establishment act apply to me at all?
2. There is no proof of employemnt with any of the complaintants . what should i do.

A

1. If you fall within the scope and ambit of S&E Act, then the Act will be applicable to you. However, details is required in order to understand your exact situation. Accordingly, minimum wages will also be applicable to you.

2. May be there is no appointment letter given by you. However, if the employees can prove (through other documents) that you have engaged them, then automatically they become your employees.
