Rights on Husband's property
« on: September 28, 2015, 03:06:09 AM »
My parents have 4 children along with me.1 Son and 3 Daughters.
My brother never cared for my parents. They lived with us and my father died in 2011.
My mother is healthy and living with us. We came to know that my brother is planning to take over my father's property through some document unknowingly singed by my father is early 90's or late 80's.
Please advise us to get my mother's legal share in my father's property. Till now no case has been filed in this regard.
My brother went to US in 2002 and is US citizen now.

If your father has left any property then you along with your mother and siblings are the present owner and it is not a filmy world that your brother will take all property with a piece of paper signed by your father. Law is prevailing in India. without physical presence of your father, your brother cannot be the owner of your father's property which is absurd in sense.

But what if he produces some paper signed by my father and write a will on it.
He did the same  once before but it was unregistered sale deed.

How to approach if he produces some paper/Will.

Thank you.

Then who will the witness and executor and how they will make it register?? Lots of hurdle he has to face to make one forged WILL of your father. Dont entertain his childish/ immature activities. If you still want any clarification regarding your situation then you can call me and that will be paid consultation.
