Agreement to sell vs Registry
« on: September 29, 2015, 11:12:34 AM »
Hello Sir,

My father purchased a property which was earlier been into Agreement to sell with person X. Person X also asked few extension period for registry which was granted by seller. But finally seller sold the property to my father with proper registry.

Now, person X filed a case in court for claim on this property and magistrate court given order in person X favor. My question is, can this be possible that a registry get invalid on ground of agreement to sell?
Just to mention my father has possession of this property since past 15 years before registry and after registry as well. person X never had any possession so far.
Please suggest

Agreement to sell means nothing if the property is registered in your fathers name lawfully no one can take that away from your father.

Give complete details of the court it surely means something. Else

Until I check your documents it is not possible to say correctly but I can say that no order can be passed by any Magistrate when the matter is civil dispute. Order can be challenge before the appellate authority.
