RCR COUNTER PETITION TIME LIMIT ?

Filed RCR - 281 OF MUHAMMADAN LAW against my wife on march first week, case was posted on the first week of june, wife hasn't come to court, court ordered counselling for july, only one counselling session , Back to the Court on august.


Court ordered  for written statement from wife within 60 days {October 10}
Case next Posted on november 10.   No written statement until now.

 I would like to know

1. The time for written statement is now over, or my wife can file written statement after 60 days.

2. Why Case Posted on november 10 {90 days}.

3. Is there a chance of a ex parte order.

4. Can she file divorce against me  after RCR ex-parte.

Generally Written statement can be filed within 30 days but court may allow further time which does not exceed 90 days from the date of receiving of summon. Moreover, Supreme Court has given liberal view in respect of filing of written statement. The provision laid down in Order VIII Rule I is directory not mandatory.

As per the load of cases, the court fix dates accordingly as well as urgency of your case.

Time will say whether your case will run on ex parte or not.

May be she can file a divorce case
