How to get the Heritage Property

hello everyone,

        How to get the Heritage property consisting of One Two floored house,a shop and some 30 tola of gold which were obtained to my father from his father. Not even one asset was earned by my father which i was mentioned above. We are two children to my parents, me and my brother.

      My brother is staying the house ( above mentioned asset , and second floor was given for rent ) and shop is looking after by my brother and my husband jointly. And the gold is in control of my brother and his wife . Now conflicts came in business and we decided to seperate by sharing all the money.

     During sharing my brother is not sharing the part of mine in the heritage property in any form. So what is the step I have to take to get the share of mine.

    Please provide the answer.

I cannot say about the fate of business until you disclose about the details of said business. In this situation, you can file a suit for partition and accounts in respect of the entire property including the shop but you cannot interfere with the business and its profit.

Thanking you Sir for your valuable reply.

Actually they are ready to split the amount earned jointly but forcing me and my son to sign on a clause of " No share is required in the Heritage Property further ".  How reasonable this is?  So how to tackle this situation ?

If possible, could you provide information for making step by step procedure in filing Patition Suit

The business is " small grocery shop includes office and schools stationary items"

Is there any way to give orders  by my mother in such a way that to sharing of her properties received from her husband after his death.

 My intention is as "Will" helps in executing the conditions according to testator views, similarly is there any document that can be executed when testator is alive.?
