The marriage between her husband and my sister didnt last for 15 days as he claims that she has white hair on her head and that she does not know to cook. So they separated now after 2 - 3  she asked for her belongings that she left in his house and he says until she gives him divorce he will not let her even touch a piece of her own belongings. We fear that if we send the divorce papers then he might go to qourt and falsely allege us for money

What belongs to the wife is called stridan and her husband has no claim over it.
Your sister should make a police complaint that her stridan is unlawfully held by her husband. That will be sufficient to get it back.

By the way does your sister want to continue with the marriage

No she does not. This man's and his brothers are actually not good people. They just tricked us by showing their good side. Now they say do whatever you want go to any court and harassing us. Since we are just a family of 4 my mother big brother,  sister and me. My mother's a little scared from them since she is lone earner and we are just studying that they might do something to us and by the way since on of their brother is a lawyer they think that nobody can do anything to them. Our family and my sis just want just want the divorce but if she give divorce directly they might claim for money

You are absolutely illogical with your bunch of ideas and suffers with wrong conception. Just file a case under Section 125 under Cr. PC.. Prior to that file a case before Chied Judicial Magistrate for issuing search warrant and recovery of all stridhan. Also lodge 498A  case against her husband.

Automatically husband will come for divorce eventually. Then your sister will claim permanent alimony as per her wish. This is the best and common procedure to escape safely from worst situation

Thank you for your reply. will it be okay to launch 498a since it is anti-dowry and they can say that she left on her own accord and they did not ask for any dowry but they do not want to give her stridan until she divorces.

Please, don't linger the simple query. It is very common. There is no question of dowry or counter dowry case. Keep it in your mind that whatever she got in her marriage all her stridhan. She has not left her matrimonial home on her wish.. She had been forced to leave that house. This will be basic advice.
