Dear Sir.

I would like to know if a society is not formed and if there are no active committee members residing in a building with most of the apartment given on lease to the developer and the developer is managing this building as a holiday home resort , in this matter who is responsible for the maintenance and who can decide and approve the maintenance fees that has been raised without notice and with a committee.

The developer has increased the maintenance fees and is asking for additional charges which i think is related to his resort, i have not gone into any leasing agreement with the developer and i am residing as a local in this building, rest of the flats are on lease and many owners have not yet taken possession.

Please advice.

Dear Sir.

I have purchased an apartment in Goa which is a holiday home resort that has 22 rooms and it is managed by the developer as holiday resort, 50% of the flat owners have gone into leasing agreement with the developer and rest of the owners have not yet taken possession. I have not gone into any agreement with the developer for leasing my apartment and neither did i give it on rent to anybody, I am residing in my apartment.

The developer has increased the maintenance charges from Rs. 2 per sqft to Rs.4.08 per sqft in this month, i want to know does the developer have the full right to increase the maintenance fees without notice?

The building 2 years old and only 11 apartment owners have registered their flats, currently there are no customers to operate the society as committee members. The developer is saying that since there are no active members residing in the building to take the responsibility he is taking personal interest in maintaining the project and he finds that the current rate of Rs.2 is not enough to maintain the project.

Does the developer have the full power to control and decide the maintenance fees, and how much he can increase  as per the society bylaw , or he has the right until the society is formed.
