How to get back the money from a cheating couple?

My mother gave a sum amount of Rs. 300,000(3 Lakh) to a women for interest of 4% on OCT 2014 . She along with her husband collected the money from my house. The money was promised to be returned within 2 months. It has been 14 months now and the money is still not returned. Interest is not been paid for the last 5 months. No bond or proof was collected at the time of transaction. But i have audio recording of the last 4 months (live conversation), on which they agree to have collected a sum of 3 Lakh and promise to return it. Everybody around the my locality is aware that she had borrowed money from my mother. Once the her husband tried to raise hand against my mother.
Please advise me on how to proceed over this case. I am confused. 3 Lakh is really a big money for us. Should i collect any more evidence to strengthen the case?

lodge a police complaint, send a legal notice and than after one month file a money recovery suit.

by the way when that person was about to harm your mother physically did you give a written police complaint.
I assume your mother is a sr.citizen that makes the matter even more serious

hi advabdul.. thanks for the reply.
no we didnt lodge a police complaint regarding the person raising his hand against my mother. My mother is not a senior citizen. We don't have any written document proof for lending the money.But i have recorded conversation and other phone call recordings. But we do it shortly. Can you please advise me further over this case. Many thanks in advance

Send a legal notice first than file a money recovery suit both civil and criminal.

Since there is no agreement between the two the onus of proof I on you.

You have to satisfy the court beyond reasonable doubt that you have given the said amount of money.

Failing which you may have to face a counter from the opposite side.
