Need Urgent Advice..........!
« on: December 31, 2015, 04:03:46 AM »
Hi , My name is Sandeep. and i want to get an expert advice on the following issue.

I gave a friend total of rupees 4 lacs as a friendly debt for his business. approx 2 lacs has been transferred online to his account and rest in cash. Now i am asking my money back but he saying to give my more time its already overdue by 8 months. As of now i only have his 2 P.D.C.

my friend saying give me 3 months more to return the money, i am ready to give him time but is it advisable that i get a promissory note from him for the same .or there any other method or document i can ask from him so that i am able to peruse any legal actions after three months ..?

Thanks in Advance

Sandeep Mishra

if he doesnt repay the money then encash the post dated cheque.if it gets dishonoured due to lack of funds then you can file a case u/s 138nia for cheque bounce.you can produce the statement of online transaction you made with him to owe his liability to give you money

Dear Sir,

If you are ready to give sometime to your friend then go ahead. If you are not willing to give more time to your friend in such case, you may deposit the cheques for encashment and if they bounce then you may file a cheque bouncing case in the court.
