Regarding Dispute over Parking
« on: January 09, 2016, 04:23:56 AM »
Dear Sir / Mam
I have purchased a ground floor property in Vaishali , Ghaziabad under Resale . This is a  3 storey building and the Builder of the Building resides on the second floor. At the time of registry to the first seller , the paper says that entire parking within the boundary wall of the building is the property of the Ground floor owner. The same matter has been registered to me as well from  the party , i have purchased.
Now the Builder is constantly fighting with me over this . He is telling that only one parking space is for the ground floor and another is for the second floor. The Inside Parking capacity is for 2 cars. The builder is telling me that he has got some affidavit from the first party which says that one car parking is for each. I was not aware of this affidavit earlier and is this affidavit valid once registry is done with complete parking space for the Ground Floor

Please guide me what to do

It is a very annoying situation facing by you. It is better to stay with your deed. If disputes arise again then you can file a suit for declaration and permanent injunction.
