Is ownership transfers to me after my father's death?
« on: January 15, 2016, 01:23:36 PM »
My father has purchased a land and also added my uncle's name on the land. Now there are two owners of that land. My family has not done any paper work regarding partition with my uncle's family. My uncle has document of the land and I don't trust him in any way. I want to know after death of my father, I will be the owner of my father's share or my uncle will be the only owner of land? Can he sell the land without my knowledge?

When the property is registered in two names.

The legal heirs can claim their respective shares after the death of the owners or owner provided that your father dies without making a will otherwise distribution of property owned by your father will go as par his wish mentioned in the registered will

After your father's death you will be owner along with your mother and siblings. Your uncle cannot sell out his undivided share to 3rd party without giving you any opportunity to purchase it. But you can serve him a notice to sell it out to you.
