Regarding blood related legal heirs
« on: January 16, 2016, 01:22:33 PM »
I am Binny Sen 34 yrs of age. I am married and have a 1 year old daughter and my wife is alive. My mother and father are alive. I too have a elder sister who is married now. My father have some ancestral property in his name. In the mean time I got involved in an extramarital relationship with a married lady and she is pregnant now and the test report shows that the child is mine who is not yet born. Now I am anticipating that she can claim my father's property which I didn't got yet. Is there any provision to make any WILL to gift the entire property to my 1 year old daughter though the property is not in my name ? Is there any provision before my father's death that I can transfer the whole property to my daughter which I shall get after my father's death? Please guide me, I am not willing to give any property to anyone who is not in a social relationship with me.

Thanks
Binny Sen

Can she claim my property or any monetary benefit legally? Is the child who is yet to be born will become my legal heir?

the child shall have all legal rights as a legitimate child has right to maintenance and inheritance rights.

You relationship is illegal but the child in the womb is your child and he/she has all rights over you. You are his father and child will be your illegitimate child. Property's share is not at all concern at this stage because you are not at all have a single share over your father's property. When you father dies then you will get some share from his property which you can transfer to your daughter at that very moment of time.
