Procedure for divorce
« on: February 05, 2016, 07:30:59 AM »
Hi,

I got married in July 2014.I have applied for annulment of marriage on December 2014,for the third hearing the respondent responded that he would have given a divorce if asked but cannot accept the allegations mentioned on the petition. On the next hearing we initiated for mutual consent on November 2015 and we have not got any response from the respondent and the lawyer till date.Kindly explain the procedure as to how to go further and what are all the possible means and ways to get divorce at the earliest

Mutual divorce means both parties agree to mutually end a marriage by way of joint petition.

Now either one of the party backs out than it won't happen.

This cannot be forced upon.

There are basically four ways to get divorced if you count just doing it yourself. The other three ways involved getting some professional assistance. They are, in descending order of complexity and expense: litigated, collaborative and mediated. In litigated divorce, you have two lawyers and you go to court and fight it out, usually with much posturing, many motions and depositions, threats and stress.
