Shop - property issue
« on: February 10, 2016, 10:02:35 PM »
My grandfather had one shop which he inherited. My father is running this shop since 1980s, but was it in my grandfather's name. My grandfather died in 2002. My father has continued to run the shop.. But on my grandfather's death the govt letter came to our home saying that the registration of shop got cancelled. But still my father continued without making any registration as there is a provision in Andhrapradesh that if the turnover is within certain limit we need not register.. My father used that provision. But my father had shown shop is in his name in Corporation after my grandfather's death. There are three brothers to my father who are now claiming share in shop. My father has certificate that he is doing it under self-employment scheme and has taken loan for the same in 1990s.. also my grandfather had himself wrote letter that he had given the present place of shop for rent to my father. Can my father's brothers claim share? What can be done by my father to safeguard & insulate it from suits? Plz guide me.

They cannot claim share of profit but they are entitled to get rent as well as share of property as joint-owner
