Early Marriage by mutual consent
« on: February 15, 2016, 08:37:51 PM »
Dear sirs,
Suppose, I got information of one person in my knowledge who has married one of his sons (age 16) to one of daughters of another of my friend (daughter's age 13). As per Indian Law this is illegal. But both the parents are agreed and relatives also have no issues. Moreover the married husband and wife themselves chose to marry and were not forced by parents to marry. Both husband and wife are happy 3 years after marriage and have one child. Both are very healthy and child is also healthy.

In such cases if I file a legal case against all these persons, will that stand valid in government?

Thankyou,
Damodara Das

The marriage was illegal but now both boy and girl are adult and their marriage is voidable. When they are willing to continue that then why you are poking your nose between their happy marital life!!

So that means that although at the time of marriage husband and wife may be minor and have illegal marriage but if they successfully pass the age till after becoming major then their staying together becomes legal although the marriage may be voidable if they mutually decide. Otherwise their staying married together is not invalid or illegal. Is this correct?

Thankyou,
Damodara Das
