Tenent not vacating - Car parking
« on: February 18, 2016, 10:40:22 PM »
We own a property 10 yrs back just 100 meters from where  currently my parents are staying (Tamilnadu). In that property the opposite land owner park his car in our property car shed for rent. At that time he pays 350 Rs as monthly rent and 2 yrs back we increased to 1500 Rs.

Since the place is primary location. We request him to vacate and reconstruct the house where we can get a better rent.

We dont have any legal agreement OR monthly rent payed by the car parking person. Since both my father and they are friends.

Now when we approach him vacate the car parking, he is asking for 10 Lakh OR he is asking us to sell the property to him which my father not ready.

What should we have to do ?

its your property and you are allowing him to park his car for dont need to give him any notice as such.just lock the gates once after he removes the car and dont allow him to park inside.if he breaks the lock and enters file a case of criminal tresspass on him

I completely agree with the suggestion given by Saravanan Advocate. I would have been given same advice if he did not.

in the absence of any lease agreement, then the lease agreement is perceived to continue month on month only.
You can any day close the gates of the premises and also remove the shed structure. Keep a name board in the premises outlining your ownership and also take restraining orders against the person from police.
