Hi,

Greetings !

I would be very grateful for competent and expert comments on the following:

In the absence of a written and documented will, do sons and daughters without any scope for intrepretation or dispute get an exactly equal share of their parents' property? This refers to the personal property of the parents and not a HUF.

2. Also if the son disputes an equal division, would the daughter have to spend much money in claiming her equal share in front of the competent courts ?

every one is eligible for a equal share irrespective of whether the person is a son or daughter of the deceased

All heirs will be the co-owners of their parents property in respect of equal share. If any one denies others equal shares then deprived/ aggrieved person have to file a partition suit.
