Need an advice
« on: February 23, 2016, 08:27:41 PM »
Hello,
Myself Anjali, a 40 yr old professional seek advice for my brother's case.
In 2001, were searching a bride for my younger brother of 30yrs & through matrimonial ad in newspaper we got response from a family in Agra in Dec 2001 & after seeing the girl we said yes to proposal (just verbally)...There had been no cermony or anyother official announcement of relationship....No wedding took place.

But after coming back home we consulted our Pandit, for date of wedding & other functions ...but due to mismatch of horoscopes, Pandit adviced relationship wud not be much favourable.... So, we were not keen to pursue the alliance further ...so, we informed the girl's family within that week itself...but they didn't took it well...& they filed an FIR against us in Jan 2002, in Agra court...where we presented ourself in court & were given bail on that day itself....

Since then, there had been no connection b/w two families, neither there had been anything happening in case....years later, in 2013 my brother got married in Delhi to one of other proposals by our relative.

But now, in 2016, we are informed, girl's family (which we had seen in 2001 in Agra) had filed an FIR again...we need to present ourselves in Agra on 17 March...

So, I wanted to know :

--What should be our next steps in this case?
--How & what precautions we need to take?
--Also, if after 14 years is a new FIR will hold relevance??

Matter is peculiar. It is better to take copy of FIR, if any, through your lawyer and better to move to High Court for same.

Thank you!!! For advice ....we are trying to get a copy of it ...

Its confusing that ...in all these years never once we got any court summon, or notice concerning the case ...
It makes us wonder if case was going on all these years???  If it was ...why we were not being informed ??
Out of the blue after 14years we had a police officer at doorstep informing abt FIR

Thanku for the advices....have contacted with Agra Police & few lawyers too ...

Now they informed ....that after 14years of inactiveness ...the case is not  b/w  individuals parties but police & us ...

Its some kind of routine procedure to bring closure to pending cases ...

Is there any such procedure?

May be there will be a procedure to finish a case but it is always suggestible to send a written letter to the officer of police station narrating about the discussions what made between you and him in written via speed post with Acknowledgement due

The notice we got is  to present in Agra court on 17 march ...
Last week we got in touch with lawyer in Agra,  & we get to know that the other party that is the girl's father is persuing  the case since 2005 ...but all these years we have not received any notice, summon of any sort ....so we had no idea a case had been filed again us ....

& now out of blue we are asked to present in court on 17th...claiming we didnt appeared on previous hearings...resulting an issue of unbailable warrant ...
We are working to seek a stay order from Allahbad court....our lawyers will go Allahabad on Monday

My query is :
--how long does it take to get stay order
--if by chance we not able to get stay & if we present ourself on 17th march ...Can they detain or arrest us & dont allow to come back to Delhi ...
My brother is a govt servant ...it will impact his career too...  :'(
