Advise needed on employment benefits being forfeited.

I was employed for 13 months in a company and on my resignation the company forfeited my incentive variable component which is included in my annual package in the pretext of not concluding my appraisal cycle.

At the time of joining the company issued me offer letter which clearly mentioned my monthly take home component and annual incentive component as payable at the end of the year without any conditions however after joining the company they handed me the appointment letter with adding the performance appraisal part as a condition for release of incentive component during the issuance of appointment letter. Does it not fall under forgery and cheating as the company attracts and hires people by issuing falsified offer letters and later changes terms of remuneration or wages to be paid. I want to know how can I fight this legally and recover my dues from the company and if my case will stand strong if I am in a position to provide both the offer letter and appointment letter which is contradictory.

Terms and conditions in the appointment letter cannot be changed/ altered/ introduced without the consent of the employee. The t&c of offer letter should tally with the t&c of appointment since only on the basis of such offer letter, you are joining the company. It surely comes under unfair labour practice.

Depending on the nature of dues, you can claim such dues legally.
