Property Rights for Siblings
« on: March 14, 2016, 01:31:10 PM »
Hello, I understand this a story like any other that you'll deal with everyday. But, any advice received will be greatly appreciated.
I am a Christian and my mother is the eldest of 4 siblings - 2 sisters and 2 brothers. Its been almost 15 years since my grandparents have passed away with no will in sight. My grandfather owned a flat in Mumbai wherein, my mother's youngest sibling (brother) currently resides with his family. He is keen to rent out the flat or lease it. However, we suspect foul play that he may sell the flat without giving his siblings their equal shares.
My questions now are:
a) If he does lease out the flat, will he be the sole landlords or will it be all fours siblings collectively? If so, are all siblings entitled to share of the revenue received from leasing out the flat for commercial or residential purpose?
b) If he does intend to sell the property, how do we go about putting a stop to it?

Hi
In your case all of the siblings (2 sisters and 2 brothers will have equal share of your grand father.
So if your youngest uncle leases out the flat, then rental agreement should be between 2sisters and 2 brothers (land lords) on one side and tenant on the other side. rentals should be divided equally amongst the children.
if your uncle is planning to sell the property, then all of the remaining siblings should send a notice to him staking their claim and also file a suit in court.
hope this helps.
