Employer not Paying
« on: March 16, 2016, 03:35:10 AM »
My employer a website called PagalParrot hired me as a freelancer to write articles for their website. they termed the job description as freelance but i was asked to work from home in the evening. Before starting my work i asked the company MD that as i'm a student so would it be possible for me to not work everyday but whenever i write something that would be frequent, you pay me 100 INR per article to which he said on a mail reply that "sorry we don't work like this". i guessed that wasn't possible so i started my work on march 1, 2016 and after going through it for a few days the content manager said that he isn't liking my content as i just write serious content more related to current topics in the news. i simply said that it wont be possible to write any kind of funny article if that what you want then it wont be possible. the MD here asked the content manager to terminate my account and asked me to stop writing. all this happened through Email. now i have worked for them for abut 12 days. i asked for my money that i should be paid in such a case as i have given my services to them. the company HR simply said that they weren't even hiring me i wrote for them even when they had not asked me to. they Took my previous email abut changing my daily work to freelance as a tool and are now now not giving me any reward for what i have written which is still on the website but now in someone else's name. what should i do in this matter as a budding writer i feel like i have been cheated on as nothing was made clear to me.

The company cannot treat students like this.
Issue a strongly worded letter to the company MD saying that you will definitely share your bad experience with your  college / school friends and their friends about the way your freelancing services were abused and tell them not to render services to you.
if you are smart/ company MD is smart, you will understand the Hidden message in my above text and definitely the company MD will pay you in full. think and act smartly young man.

Thank you sir,
i have done so now and i hope it gives him some kind of a wake up call but i hardly doubt it. they do not seem like people  who would keep morals ahead of money.

First, without going through the mails that were exchanged between you and the company it is difficult to find out whether you were appointed as an employee or as a freelancer.

If you were appointed as an employee, you can claim the 12 day's salary. If they fail then you have to approach the court.

If you were appointed as a freelancer, you can also claim the money but through money suit.

But practically speaking, both are expensive (legal cost) and time consuming.

I suggest, you send a legal notice to the company and hope for the best. Otherwise it is better to forget the amount considering the time and money you might have to spend.
