Is my sister responsible ?
« on: March 18, 2016, 06:09:38 PM »
Hello Sir/Madam,

My brother-in-law opened business on my sister's name and eventually took credit cards and loans on my sister's name. The expenditure is so huge that there is no track of it. Now my brother-in-law got expired, will my sister need to clear all those debts or is there a way to save my sister from these credit card companies and huge loans which she never got benefit of. No assets on her name or husband's name.

Is there a way legally to save apart from declaring IP. I am not trying to save her from paying debts, but these bills and loans are taken without her consent. :(

If the loan's are taken in the name of business then the creditor will take over the business and nothing will cause harm to her. Your sister may have to face legal complication. This much I can say that your sister will never have to face jail or capital punishment. have you seen what Mr. Vijay did.

On the grounds of demise of your brother in law, ask for OTS with credit cards and banks.
that should give you some time and some breather time
It is a very difficult situation as the credit cards and loans are in your sister's name(though without her consent).
if you have evidence that your sister's signature is faked and forged then you might have a chance. but proving fake and fraud is very tough
