Hi

Hi ,
A property was registered in 2009 on my name as well as my brother name during joint family separation.
Now case was filed for cancellation of property registration on me and my brother name.
I am residing outside india and the notice was received to home address.
Do I need to reply over the notice or my brother can reply over notice?

Can my brother send reply to notice as well as  mentioning I am Non resident indian?

Please suggest on the same

As per law, both you and your brother are required to defend the court case.
both of you can appoint a common lawyer, your brother can defend the case and you can file an adoption memo .
you can also appoint a Power of attorney to defend your case. however, you will be required to attend the court for giving evidence or as and when required by the court.

Your brother can defend the case with proper written statement. You can send a power of attorney or vakalatnama to your lawyer for conducting on your behalf. It is not at all will be easy to cancel a Deed on whimsical basis
