I was in High court the other day it was a division bench, two honourable judges were listening to a matter.
and the judges catches one party red handed of submitting false/fake documents.

the honourable court tells the council will you withdraw the application or do I pass an order.

the council found himself caught said he wants to withdraw.

Now my question is how dare these frauds try to mislead the honourable court.

And why would the honourable judge not punish them for deliberately mislead the court, isn't it extreme leniency.

had the judge not caught the fraud than they would have got a favourable order and that would have hurt our justice system even more.

I really don't understand this kind of leniency, please give your views on it

Asking the counsel to withdraw in the open court is the most embarrassing punishment for a lawyer.

The courts have inherent powers u/s Section 151 of CPC  to prevent abuse of the process of the court.

Not sure why the courts did not initiate proceedings against the party and the lawyer for submitting false/fake documents.
