What is Appeal Time in High Court
« on: April 01, 2016, 06:33:08 AM »
Dear Sir,s
Is there any time limit to go for Appeal in High court against the Lower court Judgment? If delayed what is the procedure..
I filed a Petition praying to grant the Divorce with my Wife. Sessions court Dismissed my divorce petition and Granted Judicial Separation on Nov 2015.
As I now within one month of the Lower court judgment we have to go for appeal  in HC. But due to some reason I did not appeal..

Please suggest me whether can I go for appeal now in High court (or) not ? if not what is the Alternate solution ?

Thanks

You can go for appeal within one months on failure you have to show reason why you have been filed appeal after 30 days with day to day explanation.

Dear Sir,

As per the provisions of Family Court Act the period for filing the appeal is 30 days but as per the provisions of Hindu Marriage ACt the period for filing of appeal is 90 days. You may always file a delayed appeal along with an application for condonation of delay by explaining the reasons of delay. Normally in matrimonial appeal delays are condoned and appeals are accepted and not dismissed on the grounds of delay.
