My brother is not looking after my widow mother
« on: April 01, 2016, 07:21:11 PM »
My brother is not looking after my widow mother. He has full control over the property. My mother has been living in my paternal uncle's home, maternal uncle's home. My mother and we three sisters have name in all the property documents (RTC, Pahani). Can you please advise as to how to help our mother so that she can live independently with no financial issues and claim right to the property?

HI
Your mother or any person authorised by her can file under THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007 . Under this act, it is a legal for children and heirs to provide maintenance to senior citizens and parents, by monthly allowance tc

Alternatively, if the properties are in her name , but in possession of your brother, you can ask for directions to handover possession of the property to your mother. She can also enter in to a reverse mortgage agreement with a bank and banks will grant loan to her for her sustainance, medical expenses etc.
Children will have the right to redeem the properties after the life time of their mother from the bank by paying the outstanding amount etc.

This Act also provides simple, speedy and inexpensive mechanism for the protection of life and property of the older personss
