Inheritance of house property

my father owned a house in rajasthan. He died intestate in1996 leaving behind my mother & 2 Sons n2 Daughters both married in the 1970s. I am married  n have a son. My elder brother married n divorced in 1986 & has a daughter in her mother's custody.Daughter is married. Who r now the legal heirs?

Hi
The legal heirs of your father are
a) your mother
b) 2 brothers and
c) 2 sisters.

Grand children and spouses are not legal heirs of your father.

Thanks for prompt reply. I've been told that in rajasthan married daughters have no claim according to law amended in 2005. Is that true?

As per new law, present owner is mother, brothers and sisters. But in case of sister, they cannot claim for partition of dwelling house under the Mitakhara Law.
