DV filed, not ready to stay still claims maintenance

My wife has filed DV against me in kurla , Mumbai court. she is not living with me and asking for alternate accommodation near her mother house and 45000 rs maintenance and for daughter as 15,000. I am earning 70,000. How much interim would be ? I told her to come n stay with us but she is not coming and also not giving statement.

Is your wife working?

Did your wife leave the house on her own will if yes she is not entitled to maintenance.

Since she has filed DV, it means it is not her head but other heads are also functioning against you.

In such a situation just pay for your child's school fee and her maintenance even before the court orders.

once you do this court will be soft on you.

in every hearing maintain that our wife deserted you and you want her back.

also maintain that in laws interference is the root cause of all problems

Dear Sir,

Your wife may not be entitled for the maintenance as asked by her but certainly some maintenance may be granted to her. She may not be willing to stay with you hence not joining your company back and filing cases to seek maintenance from you.

If your wife is working in such case, she may not be given higher maintenance amount from the court.
