Dependant Share of Property
« on: April 08, 2016, 03:47:21 AM »
My father is of 70+ years old now. He has two sons; me and my younger brother. My younger brother is physically handicapped and is shown as dependent by my father. He is also entitled to half of the pension of my father after his demise. I just wanted to know that after my father, will his (father) property automatically transfer to my younger brother as he is being shown as dependent or it will be equally distributed among two of us. Kindly suggest.

Hi
In absence of any will made by your father, the property will be equally distributed among the legal heirs. ( Legal heirs are mother, sons and daughters).

No, after your demise of your father, his property will be devolve equally on you, your brother and your mother, if she alive by that time i.e. 1/3rd undivided share.
