Urgent request for a legal help
« on: April 28, 2016, 08:43:33 PM »
I worked with MNC for the last 2 year and I was one of their best employees. The company is into email marketing and they send billions of mails on daily basis. they have their own database. I was also doing the same but i dont know last month what came into my mind that i misused the data and sent it to 30,000 users for my personal gain and I am sorry for that, which they have caught now.  I have provided all the accounts' snapshots and everything stating that I did not even earn a penny from what I have done. Its all clear in the snapshots. I thought they will give me at least a warning but they have made me write an apology letter and write everything whatever happened. I did it and even signed a Show cause notice, expecting them to give me a termination letter and letting me go.

But they with-held my salary and again calling for investigation. Please help me if I can be saved or are they going to get legal against me. I dont know what to do in the meeting now.

Please suggest if I can ask for a relieving letter too considering the 2 years of honest work I have done. I think they should show some mercy and dont write-off my 2 years of hard work because of 1 mistake I did.

Thanks.

Dear Sir,

Under the circumstances, when you have given the apology letter, please speak to your senior and ask for relieving letter from the company, if the same is not given then resign from the post immediately to save yourself from some or other investigation or enquiry.

Since you have admitted the charges, you cannot deny the misconduct any more. Now company is entitled to recover the loss if they actually suffered for your conduct.

However, in order to recover such cost, there is a procedure of conducting an enquiry, proving the charges (even though you admitted) and awarding punishment. Even if they want to recover the cost of loss they suffered they have to substantiate that they have actually suffered financial loss to that extent before legal recovering the cost from you.

Simple salary deduction would amount to unfair labour practice.

Hi,
The other option could be that you resign on your own accord and move forward.  I am aware it is painful to you, but no point in hanging around and expecting mercy from your employers. Just move on. You are talented and best amongst best . So just ignore the loss of pay of 1 or 2 months and move on.

Dear Sir,

IF they are trying to initiate the enquiry process then under the circumstances its better to resign from the job rather than facing the enquiry.
