Divorce after two months of marriage
« on: May 04, 2016, 02:37:14 AM »
Hi,
I am a christian from India.

I loved a girl for more than five years.. And she is th second cousin to me..  I know that since there is no kaw against the second cousin marriages.. I thought of marrying her. But my parents didnot agree and forced me to marry some other girl. I tried speaking to the girl before marriage and cancel it somehow but it did not happen... I got married on march 31 2016...
Now i am unable to adjust with my wife.. Im unable to show her the love.. Since I love the other girl.. Even she is not happy with me.. But she is not willing to leave me since she is afraid of the consequences after the divorce..
I told her my problem and asked her to leave me but she is not..
I really cannot be happy or make her happy... I really cannot live with her..

1. I wanted to apply for divorce now.. But on what grounds can I now appky for divorce... ?
2. What is the procedure ?
3. What happens if tbe girl is not willing for the divorce.?
4. Do I have to give half of my possessions or money  all my life to her after divroce.?
5. Since its only a month.. Is divorce required? Or annulment is possible?
6. If so, What is annulment procedure?

Looking for help.. Kindly please give me your suggestions..

Dear Sir,

There is no provision that you can apply for divorce within two months of marriage. Even the divorce on the grounds of mutual consent cannot happen within two months of marriage. For both the things, you have to wait for one year from the date of marriage.

If u want a divorce on the grounds of mutual consent, then you have to make your wife agree for the marriage. Or else there is no ground for divorce as there is no cruelty by your wife. Please forget about your cousin as you cannot marry her as per law and for her your are spoiling your present relation with your wife. Please give some time to your relation, if needed go for marriage counselling etc. Legally there is no solution to your trouble and there is no trouble.
