Married daughter right in parental property
« on: May 07, 2016, 02:10:19 AM »
I am a married woman and my grandparents have three son. Elder one is father and two are my uncle. My grandparents purchase a house and allow to my father to live in that property.  Later on time my grandparent had purchase another property with the ownership of my grandmother. My grandfather was expired in the 1990 year and my grandmother was expiring in the 2011 year.  The first property was sold and ownership of second property is transfer to my father.  Now please suggest me that:- 1. Can i claim for my share in the amount which received from first property selling amount.  2. Can i claim for my share in second property?

No.

2. Can i claim for my share in second property?
If you are guided by Hindu mitakshara school, then you have rights to claim your share from ancestral property

File a Consumer Complaint - No
Pre Nuptials Agreement - Not valid

Dear Kavita,

You need to file a suit for partition for claiming your share in the property. You don't have any right to seek any claim in the property which was already sold way back or any of the transaction amount.
