Mandatory Certification Program
« on: May 07, 2016, 07:25:11 AM »
Hello All,

I work at an Investment bank. Recently, I have been asked to certify for a UK regulatory exam. This has been introduced for the first time and it is mandatory to obtain this certification, failure to do so would hinder my career growth. I work all the teams globally and not just exclusively UK. This certification has been made mandatory only for UK and India employees. At the time of my joining, no such details were mentioned on passing any mandatory regulatory exam.

I feel that there is a certain discrimination here. I do not think that they have the right to subject an Indian national to a foreign regulatory body while leaving out employees from the rest of regions.

Can someone please advise if this is overstepping jurisdiction?

Many Thanks,

Dear Sir,

I think this certification is for your own good and growth in the job as well as career. Its up to you, whether you want to do the same or not. There is no legal issue which can be addressed. Its a requirement of the job, to do or not to do is your option.

Hello Sir,

I would have completely agreed that it is for my career progression. I would have taken it up wholeheartedly, but here I see that only employees only from a particular region are being asked to get the certification. I do not see employees doing the same job in US, Australia or Japan being asked to taken a United Kingdom certification. Hence my resistance here.

Thanks

Dear Sir,

There is no point in taking any resistance. Please pass the exam if you can and go ahead with your job happily. If you say no for the exam, you may be shutting down your own career prospects and nothing else.

Legally you can deny to participate in any such certification course and your employer cannot even force you to take part in the said course.
